1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of firstcast.shop (the “Site”) and any purchase you make through it. The Site is operated by First Cast LLC, doing business as First Cast Outfitters (“First Cast,” “we,” “us,” or “our”).

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order, you represent that you meet this requirement and that any information you provide is accurate and complete.

3. Products

Every item sold on the Site is produced on demand once an order is placed — nothing is held in pre-made inventory. We make reasonable efforts to display product colors, sizing, and details accurately, but we don't guarantee that your device's display will show colors precisely, or that a description is entirely free of error.

Prices are listed in U.S. dollars and are subject to change without notice. If a pricing error occurs, we reserve the right to cancel any order affected by that error and issue a full refund. Product availability may change at any time, and we reserve the right to limit quantities, discontinue a product, or refuse any order at our discretion.

4. Orders & Payment

Payment is processed securely through Stripe. We do not store your full payment card details. Placing an order is an offer to purchase; a contract is formed only once we confirm and process your order.

We reserve the right to refuse or cancel any order — including for suspected fraud, pricing errors, or unavailability of a product — and will issue a refund for any canceled order that was already paid for. You are responsible for providing an accurate shipping address and contact email; we are not responsible for orders delayed or misdelivered due to incorrect information you provided.

5. Shipping

Shipping timelines, international availability, and how multiple-item orders are handled are described on our Shipping & Returns page, which is incorporated into these Terms by reference.

6. Returns & Exchanges

Because every item is made specifically for your order, we're unable to accept returns or exchanges for incorrect size, color preference, or change of mind. If an item arrives damaged, defective, misprinted, or isn't what you ordered, we'll replace it or issue a refund. 7. Intellectual Property

All content on the Site — including the First Cast Outfitters name, logo, artwork, product designs, photography, and text — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written permission.

8. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, its systems, or other users' accounts;
• Interfere with or disrupt the Site's operation, including through malicious code or automated scraping;
• Use the Site to submit false, fraudulent, or abusive orders.

We reserve the right to suspend or terminate your access to the Site if we believe you've violated these Terms.

9. Third-Party Services

The Site relies on third-party services to operate, including Stripe (payment processing), Printful and Printify (order production and fulfillment), and MailerLite (email communications you've opted into). Your use of those services in connection with the Site is also subject to their own terms and privacy policies. We are not responsible for the acts or omissions of these third parties.

10. Disclaimer of Warranties

The Site and all products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, First Cast LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of any product, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or a purchase will not exceed the amount you paid for the product(s) giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless First Cast LLC and its officers, employees, and agents from any claim, loss, or demand, including reasonable attorneys' fees, arising out of your violation of these Terms or misuse of the Site.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page. Your continued use of the Site after a change is posted constitutes acceptance of the updated Terms.
